The laws may start at the central level, but state rules determine how many obligations actually apply to your workforce, offices, and factories.

  • Labour Law Compliance Varies from State to State

    Most compliance checklists consider India as one jurisdiction but that’s not true. Indian labour law includes 30+ central laws and on top of that state legislation where most changes happen. A generic all-India statutory compliance audit either includes laws that don’t apply or misses the one that are applied to you. As a conclusion, the result is wrong.

  • State obligations differ totally

    Professional tax, which is common in 21 states, is not the same for Delhi, Uttar Pradesh or Haryana. Labour welfare fund only applies in 16 states, half-yearly in Maharashtra, annually in Karnataka. Based on the city you have registered any compliance might appear.

  • Even “central” laws work differently for different states

    Minimum wages are notified by each state and are revised by DA notifications twice in a year, and split by zone and skill level. Shops & Establishments Acts — registration, working hours, leave, weekly offs, women’s night-shift rules all are dependent on state statutes. Even the registers you maintain and the returns you file are dependent on state formats.

  • New Labour Codes made compliance more state-centric

    The four codes are central law, but they operate as per the state rules defined. States like Gujarat, Karnataka and Maharashtra have notified final rules while others are still in draft.

  • Same headcount, different licences

    The Contract Labour Act legislation applies at 20 workers centrally, but Maharashtra, Karnataka, Gujarat and several others moved the threshold to 50. Canteen, creche and safety officer requirements sit inside state Factories Rules, not the central Act. The same 300-person plant ends up registering for one set of licences in Pune and a different set in Chennai.

  • One calendar cannot cover every state

    Each state runs its own labour portal, forms and due dates, like Maharashtra on MahaKamgar and Karnataka on e-Karmika. Annual returns, PT challans and LWF remittances all land on different dates. Open a second location and your existing calendar no longer covers you.

Inspections are generally carried by state labour departments, against state rates and state formats.

Being compliant “in general” means nothing to an inspector checking whether you have paid this quarter’s notified minimum wage for a skilled worker in your zone.

What does the audit check?

The audit covers the labour law compliance that actually applies to your company and skips the ones that don’t.

  • Wages & contributions In short, it checks if you are meeting your state’s minimum wage bar, whether basic pay that you provide is 50% of fixed pay as per new wage rules, and if salaries are released on time. Under contributions, it covers PF, ESI, professional tax, and labour welfare fund; it makes sure you are registered where you should be and are paying accordingly as per due dates.
  • Registration & records During registration and recording, it reverifies your shops and establishments registration and makes sure that your location is registered in its own state. It also keeps an eye on the registers that you require to maintain and checks if every employee has a wage slip and an appointment letter.
  • Policies Under policies, it covers working hours, overtime and weekly offs, leave, gratuity, statutory bonus, maternity benefit, POSH rules, policy and annual returns.
  • New labour codes readiness It also keeps a check on how ready you are for the new labour laws and if your state has released its rules.   • Our CA manages the consequences Your CA just takes care of PF, ESI and PT challans. Registers, HR policies, POSH committees, S&E renewals, contract labour records, depend solely on you. Most inspection related concerns come from the second part that fall into your bucket and not CA’s to-do.
  • We have never been inspected Well! You are lucky! But inspections are uninvited guests and as per new labour codes inspections are from randomized selection. So you never know who is next on the radar. Not being inspected does not mean that you are compliant, instead it just means you have not faced tides yet.
  • We’ve already moved to the new Labour Codes That’s good you did. The four codes mentioned came into action in November 2025, however they operate through central and state rules that are still in effect state by state. So keep checking it timely as certain ones may already have been outdated.
  • Our HR software covers it. Sorry! But let me break that bubble for you. Payroll software calculates salaries but it doesn’t check whether your salary structure meets the new 50% wage definition, whether your registers match your state’s format, or whether your policies are on point. And that’s what exactly an audit does.
